2. Applicability
These Terms apply to website use, online orders and products sold through jackedpaddy.ie. By placing an order, you agree to the applicable Terms made available before purchase. Nothing excludes mandatory consumer rights.
3. Product Information
We take reasonable steps to ensure product information is accurate. Manufacturers may update packaging, formulations and serving information, and colours may vary between devices. Such changes do not remove our obligation to supply goods that match the contract and required pre-purchase information.
Read the physical label before use, particularly ingredients, allergens, instructions and warnings. If a discrepancy may affect safety, dietary suitability or what you ordered, do not consume the product and contact us.
Where allergies, medical conditions, medication, pregnancy or breastfeeding are relevant, seek appropriate professional advice where necessary.
4. Supplements and Health Information
Website information is general information and is not intended to diagnose, treat, cure or prevent disease, or replace professional medical advice. Food supplements should not replace a varied and balanced diet and healthy lifestyle. Consult an appropriately qualified healthcare professional where appropriate. See also our Supplement and Medical Disclaimer.
5. Stimulant Products
Some products contain caffeine or other stimulants. Read warnings and usage instructions and do not exceed the recommended intake. We are not responsible for consequences caused solely by deliberate misuse, excessive consumption or failure to follow clear warnings, except where liability cannot legally be excluded.
6. Orders
Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt. Unless we expressly accept earlier, acceptance takes place when we send a dispatch confirmation. Before acceptance, we may refuse an order where payment cannot be authorised, stock is unavailable, an obvious pricing error exists, fraud is reasonably suspected, technical misuse has occurred or fulfilment is not reasonably possible.
If we decline an order after taking payment, we will refund the payment for the declined items and any associated delivery charges due back to you. Once accepted, an order will only be cancelled in accordance with the contract and applicable law.
7. Pricing
Prices are in euro unless otherwise stated and include VAT where applicable. The total price, including delivery charges, will be shown before you submit an order. Price changes for future purchases do not change an accepted order. Delivery charges are set out in our Shipping Policy.
8. Pricing Errors
Despite reasonable care, obvious and genuine pricing or technical errors may occur. Before acceptance, we may decline the affected order or offer you the opportunity to order at the correct price. We will not charge a higher price without your agreement. Payments for cancelled items will be refunded. For an accepted order, applicable contractual and consumer-law rules apply.
9. Promotions and Discounts
Promotions may have clearly stated expiry dates, product exclusions, minimum spends, usage limits, quantity limits or other conditions. Codes have no cash value, cannot be exchanged for cash and cannot be combined unless stated otherwise.
Promotions may be changed or withdrawn for future orders. We may refuse fraudulent use, automated abuse, multiple-account abuse or deliberate exploitation of a technical error, subject to statutory rights.
10. Stock Availability
Adding a product to the basket does not reserve it. If an item becomes unavailable after ordering, we will inform you and refund the unavailable item where it cannot be supplied as agreed. We will not substitute a different product without your agreement.
11. Payment
Use one of the methods offered at checkout. Transactions may be processed by third-party payment providers. Any provider-specific terms will be made available where relevant.
12. Fraud Prevention
We may conduct proportionate fraud-prevention and identity checks. Transactions may be held for verification or declined where there are reasonable grounds to suspect stolen payment details, identity fraud, unauthorised use, account manipulation or other fraud. Checks will be conducted consistently with data-protection law and contractual rights.
13. Chargebacks
Please contact us first if an order issue arises so we have an opportunity to resolve it. This does not restrict lawful rights through your payment provider.
If a chargeback is raised, we may provide banks, payment processors or payment networks with relevant evidence, including order details, tracking, delivery confirmation, communications, transaction information and acceptance of applicable Terms. A chargeback does not itself determine legal refund entitlement.
14. Resale
Products are sold primarily for personal consumer use unless otherwise agreed. We may limit order quantities before acceptance where reasonably necessary for fair availability or where orders appear to be for unauthorised commercial resale.
15. Intellectual Property
Rights in original Jacked Paddy content, including branding, logos, original photography, graphics, written content and promotional assets, belong to us or are used under licence. They may not be commercially reproduced, copied, redistributed or exploited without permission except where permitted by law. Third-party trademarks belong to their respective owners.
16. Prohibited Use
You must not interfere with the website, attempt unauthorised access, introduce malicious software, scrape content unlawfully, manipulate checkout, deliberately exploit bugs or pricing errors, impersonate another person or use the website for fraud.
17. Reviews and Customer Content
Reviews, comments, photographs and other submissions must not be unlawful, fraudulent, infringe third-party rights, contain malicious material, or be knowingly false or defamatory. We may moderate content where lawful and appropriate. Moderation must not misrepresent genuine customer feedback.
18. Third-Party Products and Links
We sell products manufactured by third-party brands. Manufacturer changes do not remove our responsibilities as seller. Review the physical label and contact us about material discrepancies.
External websites may have separate content, security and privacy practices. We do not control those sites. This does not exclude any responsibility that cannot lawfully be excluded.
19. Liability
Nothing excludes or limits liability where unlawful or restricts mandatory consumer rights. We do not exclude responsibility for our own legal obligations by referring you to a manufacturer or courier.
To the extent permitted by law, we are not responsible for losses caused solely by deliberate product misuse, exceeding clearly stated intake, use contrary to clear warnings, improper storage after delivery, unauthorised modification or ignoring a known contraindication specifically stated on the label.
20. Events Outside Our Control
Events outside our reasonable control may affect fulfilment. We will communicate material delays and take reasonable steps to address them. Your mandatory rights concerning delivery, cancellation and refunds remain unaffected.
21. Governing Law
These Terms are governed by Irish law. Consumers may also benefit from mandatory protections applicable in their country of residence. Nothing restricts use of a court or dispute-resolution procedure to which a consumer is legally entitled.
22. Severability and No Waiver
If a provision is invalid or unenforceable, remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision does not waive that or another right.
23. Changes and Related Policies
We may amend these Terms for future orders. The version applicable to your order is the version in effect when you place it, subject to mandatory law.
Read these Terms with our Shipping Policy and Returns and Refunds Policy. Our Privacy Policy and Cookie Policy explain data processing and tracking; acceptance of purchase terms is not consent to optional marketing or cookies.
